1. The service and the parties
Aktio is a profitability analytics service for businesses, provided by Genero Oy Ab (Business ID 2387598-5, Helsinki, Finland; “Genero”). It is used at app.aktio.io by companies that have entered into a customer agreement with Genero (the “Customer”). Aktio is a business service and is not offered to consumers.
These terms apply to every use of Aktio by the Customer and its users. Where Genero and the Customer have signed a customer agreement, an order or a data processing agreement, that document prevails over these terms to the extent they conflict.
2. Accounts and access
Access is granted by Genero or by the Customer’s own administrators, who decide which users may open the Customer’s accounts and dashboards. Each user signs in with their own credentials, which may not be shared. The Customer is responsible for keeping its users’ access up to date and for removing users who leave.
Genero may suspend access that it reasonably believes is being misused or endangers the service or other customers, and will inform the Customer without undue delay.
3. Acceptable use
Aktio may be used only for the Customer’s own business purposes, in accordance with applicable law and with the terms of the third-party platforms connected to it. The Customer and its users may not:
- use the service to process data they have no right to process;
- attempt to access other customers’ data or to circumvent access controls;
- reverse engineer the service, except to the extent the law allows;
- overload the service or automate access to it other than through the interfaces Genero provides (the app, its API and the MCP connection);
- resell or sublicense the service without Genero’s written consent.
4. Customer data and data protection
The Customer owns the data it brings into Aktio and the results derived from it (“Customer Data”). Genero processes Customer Data only to provide and improve the service, in accordance with the Customer’s instructions, the privacy policy and the data processing agreement between the parties.
Where Customer Data contains personal data, the Customer is the controller and Genero the processor. The Customer is responsible for having a lawful basis for the data it connects to Aktio and forwards through it, including conversion data and audiences sent to advertising platforms, and for informing its own customers. Genero is the controller of its users’ account data, as described in the privacy policy.
The Customer can export its data from the service and can request that it be deleted when the agreement ends.
5. Third-party platform connections
Aktio connects to third-party platforms, such as Meta, Google, TikTok, LinkedIn, Microsoft, WooCommerce, HubSpot, Severa and BigQuery, using the authorisation that a Customer’s user grants. Those platforms’ own terms apply to the data they provide. The Customer is responsible for having the right to connect each account, and acknowledges that a platform may change or withdraw its interfaces, in which case the related features of Aktio may change or stop working. Genero is not responsible for the content, availability or accuracy of data supplied by a third-party platform.
A user can disconnect any platform at any time in the service or through the platform’s own settings; see the data deletion instructions.
6. AI assistants
The Customer may allow its users to connect AI assistants to Aktio over MCP. The decision to do so, the choice of assistant and the assistant provider’s terms are the Customer’s responsibility. Genero returns reported metrics to the assistant and does not control what the assistant does with them.
7. Availability and changes to the service
Genero aims to keep Aktio available at all times and develops it continuously. The service may be unavailable during maintenance and updates, or for causes outside Genero’s control, such as an outage at a third-party platform. Genero does not guarantee a specific service level unless agreed in writing. Genero may change, add or remove features, and will inform the Customer in advance of changes that materially reduce the service.
The figures shown in Aktio are computed from the data supplied by the Customer and the connected platforms, which may be incomplete or delayed. Forecasts and recommendations are estimates intended to support decisions, not guarantees of results.
8. Fees
Fees, invoicing and payment terms are set out in the customer agreement or order. Unless agreed otherwise, invoices are payable by their due date, and Genero may suspend the service after a written reminder if an undisputed invoice remains unpaid.
9. Intellectual property
Aktio, its software, design, documentation, metric definitions and models, and all related intellectual property rights belong to Genero or its licensors. The Customer receives a non-exclusive, non-transferable right to use the service for the term of the agreement. Customer Data remains the Customer’s property. Feedback the Customer gives may be used to improve the service without any obligation to the Customer.
10. Confidentiality
Each party keeps confidential the non-public information it receives from the other in connection with the service, uses it only for the purposes of the agreement, and discloses it only to those who need it and are bound by confidentiality, or where the law requires disclosure. This obligation continues after the agreement ends.
11. Limitation of liability
Genero is liable for direct damage caused by its breach of these terms up to the amount of the fees the Customer has paid for the service during the twelve months preceding the event giving rise to the claim. Neither party is liable for indirect or consequential damage, such as lost profit, lost revenue, lost data or business interruption. These limitations do not apply to damage caused intentionally or by gross negligence, or where liability cannot be limited under mandatory law. The Customer is responsible for the decisions it makes on the basis of the figures shown in Aktio.
12. Term and termination
These terms apply for as long as the Customer has access to Aktio. The term and notice period of the service are set in the customer agreement. Either party may terminate the agreement with immediate effect if the other party materially breaches it and does not remedy the breach within a reasonable time after written notice, or becomes insolvent.
On termination, access ends. Genero deletes or returns Customer Data in accordance with the data processing agreement, except for data it must keep under law, which is deleted when that obligation ends.
13. Other terms
Genero may update these terms. The current version is at aktio.io/terms/, with the date of the last update at the top. Material changes are announced to the Customer in advance, and continued use of the service after they take effect constitutes acceptance. Neither party may assign the agreement without the other’s consent, except that Genero may assign it in connection with a merger or a sale of its business. Neither party is liable for a failure to perform caused by circumstances beyond its reasonable control.
14. Governing law and disputes
These terms are governed by the laws of Finland, excluding its conflict-of-law rules. Disputes that cannot be settled by negotiation are resolved by the District Court of Helsinki as the court of first instance.
